NOUVEL OUVRAGE/NIEUWE PUBLICATIE: Procès du Tribunal de la Chambre impériale

Endommagés lors du bombardement de 1944, plus de 200 dossiers de procès du Tribunal de la Chambre impériale viennent d’être restaurés. Publié en février 2019, l’ouvrage « Trésors de procédure » retrace l’histoire de ces archives et permet découvrir quelques-une des plus belles pièces.

Les dossiers du Tribunal de la Chambre impériale (1495-1806) sont composés de milliers de procès. Plus de 2.000 d’entre eux sont conservés aux Archives de l’État à Liège. Ces dossiers de procès décrivent entièrement la procédure judiciaire. Ils regorgent de pièces justificatives dont la valeur iconographique et esthétique force l’admiration : cartes, plans, arbres généalogiques, dessins, etc.
Quelque 225 dossiers de procès, soit plus de 25.000 feuillets viennent d’être patiemment restaurés et 28 belles pièces ont fait l’objet de soins particuliers. Le 24 décembre 1944, en effet, le dépôt des Archives de l’État à Liège était touché lors d’un bombardement allemand qui avait pour cible le réseau ferroviaire liégeois. Une partie des archives de la Chambre impériale avait alors été détruite et une autre gravement endommagée par le feu et la neige. 

La Chambre impériale

En 1495, l’Empire germanique créait une nouvelle cour de justice. Installée à Wetzlar à partir de 1673, la Chambre impériale (Reichskammergericht) faisait office de juridiction suprême en matière civile. Les habitants originaires des anciennes Principautés de Liège et de Stavelot ont eu recours à ce tribunal jusqu’à la fin de l’Ancien Régime. En 1856, les archives relatives à nos régions ont été transférées de Wetzlar (Allemagne) à Bruxelles, puis l'année suivante aux Archives de l’État à Liège.

L’ouvrage

Paru en février 2019, l’ouvrage Trésors de procédure est le résultat de plus de six années de recherche. Le projet, destiné à faire renaître ces documents et leurs trésors de procédure, a été financé par la Politique scientifique fédérale (Belspo), avec l’intervention du Fonds Baillet Latour.

Jan Dumolyn, Vakgroep Geschiedenis UGent (Henri Pirenne Instituut voor Middeleeuwse Studies) is op zoek naar twee doctorandi (Phd-studenten).
Kandidaten kunnen solliciteren tot 1 mei 2019. Ook veelbelovende master-studenten die op dat moment hun diploma nog niet behaald hebben, komen in aanmerking.
De geselecteerden zullen vanaf 1 augustus of desgewenst later in dienst kunnen treden van de UGent. Het betreft een voltijdse aanstelling van 2 maal 2 jaar als doctoraatsbursaal. Als personeelslid van de UGent kan u rekenen op een aantal voordelen, zoals 38 dagen vakantieverlof, fietsvergoeding, terugbetaling van uw abonnement op openbaar voor vervoer voor woon-werkverkeer, ecocheques en een ruim opleidings- en vormingsaanbod
  1. Een positie van doctoraatsbursaal gefinancierd door een GOA-project (geconcerteerde onderzoeksactie, toegekend door het Bijzonder Onderzoeksfonds van de UGent) High Tide – Low Tide. Bruges’ late-medieval harbour system as a maritime cultural landscape (promotoren Wim De Clercq, archeologie, Stephen Louweye, geologie en Jan Dumolyn).
U onderzoekt het historisch luik in een interdisciplinair project met betrekking tot de vorming van het commerciële landschap in het middeleeuwse Zwin-landschap en de handelsmetropool Brugge. Uw onderzoek is specifiek gericht op de import van bulkgoederen in middeleeuws Vlaanderen, ten behoeve van de artisanale industrie en de voedselvoorziening van de stedelijke bevolking.
U hebt een goede kennis van paleografie, middeleeuwse archiefdocumenten, Middelnederlands, Middelfrans en Middeleeuws Latijn (het is zinloos te kandideren indien u niet vooraf over deze technische capaciteiten beschikt, of deze op zeer korte termijn kan bijspijkeren). Daarnaast beschikt u over de nodige onderzoekscapaciteiten, beheerst u het Engels uitstekend en hebt u een minstens passieve kennis van het hedendaags Frans en Duits.
U bent bereid periodes door te brengen in buitenlandse archieven en binnen een interdisciplinair team te functioneren.

Atelier sur l'archivage dans les administrations des Temps Modernes - Workshop rond archiefvorming bij stedelijke instellingen in de vroegmoderne periode

À partir de la fin du XVe siècle, la production d’archives des pouvoirs publics, d’institutions et de personnes privées a connu dans toute l’Europe une évolution accélérée. Le nombre de types documentaires a considérablement augmenté et de nouvelles méthodes de gestion et de conservation ont vu le jour. Dans le cadre du projet Temas, les Archives de l’État et le département Temps modernes de la KU Leuven organisent ce 15 mars 2019 aux Archives de l’État à Louvain un atelier sur  les évolutions dans la production d’archives des administrations communales du XVe au XVIIIe siècle.
Au cours de cet atelier, archivistes et chercheurs discuteront des origines et des évolutions d’importants types documentaires et séries d’archives communales, notamment les registres scabinaux, les registres de quartiers, les comptes, etc.  
L’atelier se déroulera de 9h30 à 16h. Il débutera par des exposés introductifs. S’en suivront des études de cas. La journée se clôturera par une table-ronde.  
Le projet Temas vise à développer une base de données dans laquelle le jargon archivistique de l'époque des Temps Modernes sera explicité de façon conviviale aux utilisateurs d’archives.  
La participation à l'atelier est gratuite. Il est cependant nécessaire de s'inscrire au préalable par email.

Vanaf de late vijftiende eeuw trad een versnelde transitie op in de archiefvorming van overheden, instellingen en particulieren over heel Europa: de documentproductie groeide sterk aan, tal van nieuwe documenttypes zagen het levenslicht en innovatieve beheer- en bewaarmethodes vonden hun ingang. In het kader van TEMAS, een BRAIN-project van het Belgisch Federaal Wetenschapsbeleid, organiseren het Rijksarchief en de onderzoeksgroep Nieuwe Tijd van de KU Leuven op 15 maart 2019 in het Leuvense Rijksarchief een workshop over deze transities in de archiefvorming van stedelijke instellingen van de vijftiende tot de achttiende eeuw.
Tijdens de workshop staan specialisten uit het werkveld, zowel archivarissen als onderzoekers, in het bijzonder stil bij de totstandkoming en evolutie van belangrijke reeksen en documenttypes in de stedelijke archieven, zoals bv. schepenregisters, wijkboeken en rekeningen. De workshop, van 9.30u tot 16.00u, vangt aan met enkele inleidende lezingen, gevolgd door de presentatie van casestudies, en wordt afgesloten met een rondetafeldiscussie.

ZAP VACATURE GESCHIEDENIS VAN HET PUBLIEKRECHT AAN KU LEUVEN (DEADLINE 28/03/2019)

Aan de faculteit Rechtsgeleerdheid, onderzoekseenheid Romeins Recht en Rechtsgeschiedenis, wordt een voltijds ambt in het zelfstandig academisch personeel vacant verklaard in het domein van Geschiedenis van het Publiekrecht. De opdracht omvat academisch onderwijs, wetenschappelijk onderzoek en wetenschappelijke dienstverlening.


Opdracht
Onderzoek
De opdracht omvat onderzoek in de geschiedenis van het publiekrecht. De kandidaat heeft een bewezen interesse en internationale reputatie binnen het gebied van de geschiedenis van het constitutioneel recht, internationaal recht en/of mensenrechten. De voorkeur gaat uit naar iemand die juridische ontwikkelingen kan plaatsen binnen hun maatschappelijke en internationale context, een visie heeft op de europeanisering en mondialiseringvan de rechtswetenschap en die de rechtsgeschiedenis ziet als een integraal onderdeel van het juridische denken.
Voor het rechtshistorische onderzoek wordt van de kandidaat verwacht zelfstandig onderzoek te verrichten op het internationale forum. Het behoort tot de opdracht van de aangestelde kandidaat om – in samenwerking met de andere leden van de onderzoeksgroep – een internationaal competitief onderzoeksprogramma uit te bouwen en excellente wetenschappelijke resultaten na te streven. Het begeleiden van doctoraten behoort eveneens tot haar/zijn takenpakket. Van de kandidaat wordt verwacht dat zij/hij een voorstel van onderzoeksprogramma op middellange termijn toevoegt aan het sollicitatiedossier.
Onderwijs
Van de kandidaat wordt verwacht dat haar/zijn onderwijsprestaties voldoen aan de excellentie-eisen die aan academische opleidingen worden gesteld wat niveau, oriëntatie en academisch gehalte betreft. Engagement voor de kwaliteit van de opleidingen als geheel wordt als vanzelfsprekend beschouwd. De onderwijsopdracht omvat de opleiding van grote aantallen studenten. De kandidaat kan ingezet worden op de campussen van Leuven, Kortrijk en Brussel. Daarnaast zijn er seminaries te verzorgen voor beperkte groepen, masterproeven individueel te begeleiden en zal de benoemde kandidaat rechtsgeschiedenis ruim tijd uittrekken voor de opleiding van doctorandi.
Dienstverlening
Van de kandidaat wordt verwacht dat zij/hij bereid is om mee te werken aan de universitaire dienstverlening en ook op termijn bereid is beleidstaken op te nemen binnen de faculteit. De kandidaat staat eveneens ter beschikking van overheid, samenleving en pers voor wetenschappelijke dienstverlening en duiding.
Profiel
De kandidaat heeft gedoctoreerd en minstens één diploma behaald dat uitgereikt werd door een rechtsfaculteit. De kandidaat is internationaal toonaangevend in haar/zijn vakgebied. Uit haar/zijn publicatielijst blijkt een betrokkenheid bij het internationaal rechtshistorisch onderzoek. Een gedegen visie op en bekwaamheid tot het verwerven van externe onderzoeksmiddelen strekt tot aanbeveling. De kandidaat heeft bij voorkeur ervaring in het verstrekken van academisch onderwijs en beschikt over aantoonbare didactische vaardigheden. Hij/zij bezit een degelijke techniek om grote groepen op kennis en vaardigheid te testen.
Ruime ervaring in onderzoek en onderwijs is een duidelijk pluspunt, waarbij mee de complimentariteit met de onderzoeksgroep moet worden bewaakt.
Een goede kennis van het Engels is een vereiste.
De bestuurstaal van de KU Leuven is het Nederlands. Als u bij aanwerving geen of onvoldoende Nederlands kent, voorziet de KU Leuven in een opleidingsaanbod dat u moet toelaten om deel te nemen aan bestuursvergaderingen. Vooraleer u een lesopdracht in het Nederlands of Engels doceert, wordt u de gelegenheid geboden om de daartoe vereiste kennis van het Nederlands resp. Engels te verwerven.
De kandidaat is bereid zich zo nodig in nieuwe materies in te werken. De aangestelde kandidaat dient tevens over de nodige sociale vaardigheden en leidinggevende capaciteiten te beschikken om zich collegiaal en flexibel in teamverband in te schakelen in de faculteit, de onderzoekseenheid en de onderzoeksgroep.

Wij bieden u een dynamische en internationaal georiënteerde onderzoeksomgeving.
De Onderzoekseenheid Romeins Recht en Rechtsgeschiedenis is ingebed binnen de Faculteit Rechtsgeleerdheid. De faculteit beschikt over een uitgebreid nationaal en internationaal netwerk zowel binnen de academische als de juridische wereld.
De benoeming gebeurt in één van de graden van het zelfstandig academisch personeel (tenure track met evaluatie na 5 jaar / docent, hoofddocent, hoogleraar of gewoon hoogleraar), afhankelijk van uw kwalificaties.
De KU Leuven voert een gelijke kansen- en diversiteitsbeleid.
De KU Leuven is goed uitgerust om buitenlandse professoren en hun familie te verwelkomen en biedt praktische ondersteuning op het gebied van immigratie en administratie, huisvesting, kinderopvang, Nederlands leren, partner loopbaancoaching...  Om wetenschappelijke integratie en onderzoek in de eerste fase te faciliteren wordt een startfinanciering van 100.000 euro aangeboden aan nieuwe professoren, die geen substantiële andere financiering hebben en die minstens voor 50% aangeworven worden.

XXVth Annual Forum of Young Legal Historians

Historically, the concept of citizenship encompassed three distinct, yet interconnected dimensions. The first and foremost dimension was of a legal nature: citizenship was a legal status which allowed one to act freely in accordance with the law and, when necessary, to claim its protection. In its second dimension citizenship presupposed one’s active participation in society’s political institutions. And last, though certainly not least, citizenship was closely linked to membership of a specific community that provided a distinct source of identity. All three dimensions were closely related to each other. This can perhaps be most aptly exemplified in the ancient boast of ‘Civis romanus sum!’, which encapsulated simultaneously a plea for legal rights, a republican sense of duty, and a distinctly Roman feeling of the imperial pride. Since the nineteenth century, these dimensions have been linked predominantly to the modern nation-state, a model which is nowadays increasingly challenged on the internal as well as the external level. Internally, many states are seen to be struggling with federalism, separatist movements, legacies of colonialism and right-wing identity politics. Externally, today’s governments are confronted with issues, such as climate change, demographic shifts, migration streams and a global and interdependent economic system, that require international cooperation or even supranational institutions.
The XXVth Annual Forum of the Young Legal Historians aims to shed light on these questions by looking at the legal history of the closely intertwined concepts of citizenship and legal history. Throughout history, citizenship and identity has been defined in different ways and at different levels. For instance, in antiquity the often smallish Greek poleis could hardly be compared to the expansive Roman Empire. Medieval life in Europe consisted of a feudal patchwork of kingdoms, principalities and free city-states, yet all were considered part of Christendom. Identity could also be determined by social class (e.g. aristocratic families) or by profession (e.g. the guilds). The nineteenth century saw the rise of nationalism and revolution, whilst at the same time European powers expanded their colonial empires. Despite these evolutions, it cannot be denied that there is also much continuity to be found. Although diversity and globalisation have reached an unprecedented scale and form today, these phenomena are not entirely new. Each era has had its international relations, its trades, wars, economic discrepancies, migrants and refugees.
There is, in short, enough reason to expect that we can learn from history. Such an endeavour necessitates a multidisciplinary approach since legal constructions can be fully appreciated only when combined with insights from the related fields of history, philosophy, political science and sociology. Therefore, the organizers welcome both traditional approaches in legal history and methodologically innovative research.

It is also possible to apply for a full panel. In that case, your proposal should also include, in addition to individual paper proposals, an abstract introducing the theme of the panel. Presentations have to be in English and should not exceed 20 minutes each. The conference fee will be € 100,- and does not include accommodation. Felicitaties van de Redactie

De redactie feliciteert de laureaat van de TPR-Prijs (Tijdschrift voor Privaatrecht), Sebastiaan Vandenbogaerde, voor zijn artikel "Justice ou liberté ? De impact van de Eerste Wereldoorlog op het Belgische privaatrecht". Sebastiaan Vandenbogaerde deelt de eerste plaats met Michael de Potter de ten Broeck en zijn bijdrage “De overmachts- en de imprevisieleer: één gespleten persoonlijkheid?”.

Sinds 1989 wordt jaarlijks de Prijs van het Tijdschrift voor Privaatrecht uitgereikt. De TPR-Prijs geldt als aanmoediging voor een jonge jurist(e) die de beste rechtsvergelijkende bijdrage van de afgelopen jaargang in het tijdschrift heeft geschreven. De prijs bedraagt thans 2.500 euro.

Depuis 1989, un prix est décerné par le Tijdschrift voor Privaatrecht chaque année. Le prix TPR récompense un(e) jeune juriste pour sa contribution parue dans la revue durant l'année écoulée. Le prix est actuellement de 2 500 euros.

Local traditions v. academic law: collateral rights on movables in Holland (c. 1300-c. 1700) (Dave De ruysscher & Ilya Kotlar)
In the County of Holland, in the sixteenth and seventeenth centuries the rules regarding security interests in movables changed fundamentally. Rules of doctrine came to be combined with rules found in local law, that is the bylaws of cities and regions. This went together with the re-interpreting of fragments of older bylaws. In 1631 Grotius’ Inleidinghe categorized the lien of the unpaid seller after delivery of the merchandise sold as entailing a reivindicatio. This new rule was adopted in cities in Holland, even though it ran counter the earlier approach that third-party effects of sales in this regard were very limited. Also, the new line of thought that holders with a legitimate title did not respond to pledgees pushed out older conceptions on tracing for some special pledges. In their legal writings Dutch authors after Grotius attempted to construe consistent solutions; in the legislative practice of cities, older rules could be preferred over new ones. Bylaws of cities, to which authors of Roman-Dutch doctrine referred as well, stipulated limits on tracing by unpaid sellers. All the mentioned developments were not determined by changes in the market, even though they could be incited by them. Legal change in Holland, even in the Golden Age of the seventeenth century, was due more to the embracing of academic ideas than to responsiveness to economic conditions.
Patent and innovation during the Industrial Revolution in England. Reflections on Josiah Wedgwood (1730-1795) (Deming Liu)
The article explores the role of patent or lack thereof in Josiah Wedgwood’s business. It first discusses the motive behind his opposition of extension of Richard Champion’s patent and then delves into his defence of his own patent in the dispute with the alleged infringer. It aims to show the incongruence of words and deeds of a tradesman with respect to patents; more importantly, it sets out to demonstrate that the claim of patent as an incentivising measure does not bear out as far as Wedgwood is concerned; rather, it is lack of patent protection that facilitates innovation in his pottery business.
Entrenchment Clauses in the History of Modern Constitutionalism (Michael Hein)
This article examines the origins, differentiation, and migration of constitutional entrenchment clauses from the beginning of modern constitutionalism until today. It is based on a broad understanding of ‘entrenchment clauses,’ covering all constitutional provisions that make amendments either to certain parts of a constitution or under certain circumstances more difficult to achieve than ‘normal’ amendments or even impossible, i.e., legally inadmissible. In particular, the article answers three questions: (1) When, and in which contexts, did the different types of constitutional entrenchment clauses emerge? (2) How have these types spread globally? (3) Which constitutional subjects do such clauses protect, and thus, which main functions do they aim to fulfill? The article is based on the new and unique Constitutional Entrenchment Clauses Dataset (CECD), which comprises 860 written national constitutions worldwide from 1776 until the end of 2015.
‘Strasbourg was something new, it was an adventure’. A history of the Belgian cases before the European Court of Human Rights in the 1960s, 1970s and 1980s (Laurens Lavrysen)
Abstract:
In recent years, a burgeoning literature has focused on the history of human rights in general and the history of the European Convention on Human Rights (ECHR) in particular. In order to understand how the ECHR gradually managed to gain authority in diverse national settings, it is necessary to complement transnational historical perspectives with studies of national reception histories. The present article approaches the history of the ECHR in Belgium by focusing on the history of the Belgian cases in Strasbourg, which have played an important role in contributing to the ‘discovery’ of the ECHR in the Belgian legal system. On the basis of interviews with actors involved in the early cases against Belgium, it was possible to determine their position in the Belgian legal landscape as well as their motivations and aspirations in going to Strasbourg. Moreover, these interviews allowed gaining insight into the circumstances out of which litigation against Belgium arose.
